PTO Direct USA – Terms of Service

Welcome to PTO Direct USA. The terms “we,” “us,” and “our” refer to PTO Direct USA. These Terms of Service (“Terms”) govern your access to and use of our website, online store, products, and related services (“Services”). The Services are hosted by Shopify, which enables us to operate the store.

By accessing or using the Services, you agree to be bound by these Terms as well as our Privacy Policy. If you do not agree, discontinue use of the Services immediately.

1. ACCESS & ACCOUNT

You represent that you are at least the age of majority in your state or province of residence. You agree to provide accurate, current, and complete account, billing, and shipping information.

You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. Accounts may not be transferred or licensed to others.

2. OUR PRODUCTS

We strive to accurately display and describe all products; however:

  • Colors and appearance may vary depending on device settings
  • Images may differ slightly from actual production
  • Specifications may change at any time
  • We may discontinue or limit products without notice

We do not guarantee that products will meet your expectations or appear exactly as depicted.

3. FITMENT RESPONSIBILITY (IMPORTANT)

PTO Direct USA may offer general guidance to assist with selecting the correct PTO clutch or replacement part. However, all fitment assistance, recommendations, or guidance—whether verbal, written, or implied—is informational only and does not constitute a guarantee of proper fitment.

The customer is solely responsible for confirming correct part selection, including but not limited to:

  • OEM part numbers
  • Pulley diameter
  • Bore size
  • Rotation direction (CW/CCW)
  • Connector/plug type
  • Mower model and sub-model compatibility

We strongly encourage customers to verify all specifications before installation.

Returns

We accept returns for unused, uninstalled, and undamaged items only, in accordance with our Refund Policy.

No Liability for Damage

By purchasing from PTO Direct USA, you agree that:

  • Mis-fitment
  • Incorrect installation
  • Improper electrical wiring
  • Operation outside recommended specifications
  • Damage to the clutch, mower, engine, wiring, deck, or other equipment

…is entirely the responsibility of the customer.

PTO Direct USA is not liable for any damage, loss, or cost resulting from mis-fitment, installation errors, or misuse of any product.

4. ORDERS

Placing an order constitutes an offer to purchase. We may accept, reject, or cancel any order at our discretion. Orders are accepted once payment is processed and confirmation is issued.

Please review all information carefully before submitting an order, as cancellations may not be possible once processing begins.

All purchases are for personal use unless explicitly approved for resale by PTO Direct USA.

5. PRICES & BILLING

Prices, discounts, and promotions may change without notice. Posted prices exclude taxes and shipping unless stated otherwise.

You agree that all payment information submitted is accurate and authorized. You must update expired or changed payment details promptly.

6. SHIPPING & DELIVERY

Delivery times are estimates only and not guaranteed. Once a product is transferred to the carrier, title and risk of loss transfer to the customer.

We are not responsible for:

  • Carrier delays
  • Weather issues
  • Customs delays
  • Incorrect shipping information provided by the customer

7. WARRANTY (1-YEAR LIMITED)

Unless otherwise noted, PTO Direct USA provides a 1-Year Limited Warranty against manufacturing defects in materials or workmanship.

This warranty does not cover:

  • Incorrect installation
  • Normal wear
  • Mis-fitment
  • Electrical wiring issues
  • Overheating caused by improper use
  • Damage resulting from misuse, abuse, or modification

Warranty claims may require product return for inspection and proof of purchase.

8. RETURNS (30 DAYS, UNUSED ITEMS ONLY)

Returns are accepted within 30 days of delivery for unused, uninstalled, and undamaged products only.

  • Buyer pays return shipping
  • Items showing signs of installation or wear are not eligible
  • Refunds are issued only after inspection

9. INTELLECTUAL PROPERTY

All trademarks, logos, product images, descriptions, and content on the Services are owned by PTO Direct USA or its licensors. No material may be reproduced or distributed without written permission.

10. OPTIONAL TOOLS

Optional features or third-party tools are provided “as is,” without warranty or liability. Use is at your own risk.

11. THIRD-PARTY LINKS

We are not responsible for content, accuracy, or products offered on third-party websites. All interactions with such sites are undertaken at your own risk.

12. RELATIONSHIP WITH SHOPIFY

Sales occur directly between the customer and PTO Direct USA. Shopify is not responsible for order fulfillment, product quality, or any transaction-related issues.

You expressly release Shopify from any claims arising out of purchases made through PTO Direct USA.

13. PRIVACY POLICY

Your use of the Services is governed by our Privacy Policy and Shopify’s Privacy Policy. Personal information may be transmitted to Shopify or third parties to enable order processing.

14. FEEDBACK

Feedback and reviews submitted to PTO Direct USA grant us a perpetual, royalty-free license to use such content for any purpose.

15. ERRORS & OMISSIONS

We reserve the right to correct any inaccuracies, omissions, or typographical errors at any time without prior notice.

16. PROHIBITED USES

You may not misuse the Services, violate laws, upload malware, interfere with functionality, attempt unauthorized access, or engage in any prohibited conduct outlined in these Terms.

17. TERMINATION

We may suspend or terminate access at any time for violations of these Terms. Relevant provisions survive termination.

18. DISCLAIMER OF WARRANTIES

Except where expressly stated, all Services and products are provided “AS IS” and “AS AVAILABLE” without warranties of any kind.

19. LIMITATION OF LIABILITY

To the fullest extent permitted by law, PTO Direct USA shall not be liable for indirect, incidental, punitive, or consequential damages, including losses resulting from fitment errors, installation issues, website reliance, or misuse of products.

20. INDEMNIFICATION

You agree to indemnify PTO Direct USA from claims arising from your misuse of the Services or violation of these Terms.

21. SEVERABILITY

If any portion of these Terms is found unenforceable, the remainder shall continue in full force.

22. ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and PTO Direct USA.
